GENERAL TERMS AND CONDITIONS

for Developers using the CAPTCHAs provided by Creo Group (Supplier)

  1. Definition of Service
    1. Supplier provides Developer with CAPTCHA service (Service).
    2. CAPTCHA is an acronym that stands for Completely Automated Public Turning Test to Tell Computers and Humans Apart. CAPTCHA is a type of challenge-response test used in computing to ensure that the response is not generated by a computer.
    3. Supplier provides access to free or pay CAPTCHAs. It shall be under the consideration of the Supplier to decide into which category a particular CAPTCHA falls.
  2. Rights deriving from the use of the Service
    1. When using the Service the Developer shall have the right
      1. to represent CAPTCHAs on the websites managed by the Developer.
      2. to enable the visitors of the website to solve the tests given to them by the CAPTCHAs.
      3. to check whether the answer given by a visitor was correct or not.
    2. In addition to clause 2.1. the Developer has the right free of charge
      1. to create any number of profiles from the free-of-charge CAPTCHAs
      2. to use the profiles on any number of websites
      3. to use the Service a certain number of times within a given period. It includes a daily limitation and another limitation for a shorter time period. The daily limitation is to be imposed on the level of attendance, whereas the aim of the other limitation for a shorter time period is to avoid peak loads. The Developer shall be informed about the limitations by the Supplier on the website of the Service. In case the Developer exceeds this limit, they shall be notified and the Supplier may reduce the Service.
    3. The content appearing in the free CAPTCHAs shall be defined by the Supplier. The Supplier shall try to achieve but shall not guarantee that in case of free of charge CAPTCHA requests the CAPTCHA profile required by the Developer shall appear.
    4. In addition to clause 2.1. in exchange for paying a fee, the Developer has the right
      1. to create any number of profiles from the pay CAPTCHAs
      2. to use the profiles on any number of websites
      3. to use the Service a certain number of times within a given period. It includes a limitation for a time period shorter than a day (avoiding peak loads). The Developer shall be informed about the limitations by the Supplier on the website of the Service. In case the Developer exceeds this limit, they shall be notified and the Supplier may reduce the Service.
    5. The Supplier hereby agrees to deduce credits only if the appearing CAPTCHA is in accordance with the profile chosen by the Developer.
  3. Registration
    1. To use the Service the Developer is obliged to create a user account on the Supplier’s website. A registered Developer has the right to use either free or pay CAPTCHAs.
    2. The Supplier provides facility to create a trial user account. In this case only the minimum identification data are required from the Developer to accelerate the registration procedure. The aim of this trial account is to become familiar with the Service. The Supplier shall provide only restricted Service for those Developers who only have a trial account. The type or extent of the restriction are subject to changes made by the Supplier. After completing the registration, the restrictions are to be reduced to the level of general users.
    3. By creating a user account, the Developer shall have the right to create a profile. When creating a profile, the Developer is to choose among the basic CAPTCHA types then he may refine their properties.
  4. CAPTCHA requests
    1. The Developer acknowledges it to be a feature of the Service that the Service is provided from a ready-made CAPTCHA pool, and the CAPTCHAs are not made at the time of CAPTCHA request.
    2. The Supplier provides a pool containing CAPTCHAs fitting the profile created by the Developer.
    3. Each CAPTCHA request is considered to be a separate Service. It is considered a CAPTCHA request if the software designed by the Developer asks the Service for CAPTCHAs. (A CAPTCHA request is not identical to the actual representation of a CAPTCHA: it is possible that the software designed by the Developer will not show the CAPTCHA to a visitor of the website.)
    4. The Developer may decide whether to choose free or pay CAPTCHAs. For pay CAPTCHAs they can pay by credits. One CAPTCHA request costs one credit. The Developer can buy credits on HelloCaptcha website in different packages. The list of current packages (along with the number of credits and their value) is available on the website of the Service.
  5. Use of embed code
    1. The Developer agrees to use the Service only with the help of the embed code provided by the Supplier and consents to upgrade the current embed code in two weeks the latest if notified via email of any new embed code issued by the Supplier.
  6. Other conditions
    1. The Supplier agrees to handle the information that is acquired by them while providing the Service and which information may refer to the content or attendance of the website as confidential.
    2. The Supplier agrees to pay proper attention so that the data submitted to them during the registration procedure could not be accessed by a third party.
    3. The Developer is entitled and obliged to keep track of and keep the regulations of the General Terms and Conditions.
    4. The Supplier is entitled to stop providing Service on the website operated by the Developer and/or ban the Developer's CAPTCHA account in case any violation of the General Terms and Conditions is observed or any reasonable doubt arises. If the account is banned, the Developer loses the right to use the Service.
    5. The Supplier is not obliged to notify  the Developer if the CAPTCHAs are not displayed properly on the website of the Developer to the end-users or the end-users of the CAPTCHAs do not complete the identification procedure adequately or use them improperly.
    6. The Supplier shall not guarantee that the CAPTCHA will continue to work uninterrupted. Down time may occur in case of:
      1. any public internet, network or system failure,
      2. any failure of the Developer's computer, system or local access,
      3. previously announced maintenance or
      4. circumstances that are beyond the Supplier's (or their affiliates') control (acts force majeure) such as strikes, rebellions, fire, flood, explosion, war, government orders, working conditions, earthquake, natural disaster or the disconnection of the internet service where the server of the Supplier (or its affiliates) or that of the Developer are located.
    7. In the present Terms and Conditions the Supplier shall not grant an SLA, but it does not exclude the possibility that under specified particular terms and conditions the Supplier may grant an SLA.
    8. The present Terms and Conditions apply only for the legal relation between the Supplier and the Developer, it only contains terms referring exclusively to CAPTCHAs and shall not affect any rights and obligations of a third party.
